Title: 1.01 beta is the patch?

1}  Why isn't the patch on the refit utility?
 
2} Why does it say on the Ativision site the the patch is not supported?
 
3} Why does it say not to use it with Dynaverse games?

Beta Patch

Definition: Not official, trial only. A good way to see how well it works with many users trying it out, with feedback to Taldren to tell how well it works and also any problems encountered.

BTW, there are beta D3 servers up and running.
